Do You Need a Permit for a Retaining Wall in Ballarat? Council Rules Explained

Permit rules catch a lot of homeowners out. This is a general guide only – always confirm your project with a registered building surveyor or the City of Ballarat building department before work starts.

When a building permit is usually needed

In Victoria, a building permit is generally required for a retaining wall more than 1 metre high, and may also be needed for lower walls that support a load, such as a driveway, building or another wall, or that could affect a neighbouring property.

Engineering

Walls that need a permit normally also need an engineer's design showing footing size, post spacing and drainage.

Planning rules

Separately to building permits, planning overlays (such as heritage, vegetation or flood overlays) can affect what you're allowed to build. Your council can tell you which overlays apply to your property.

Boundary walls

If a wall is on or near the boundary, talk to your neighbour early. Fencing and boundary rules may apply, and walls that hold up a neighbour's land need extra care.

What happens if you skip the permit?

Unpermitted structures can cause problems when you sell, with insurance, or if the wall fails.

When you request a quote, mention the height and what the wall is holding back, and the builder can tell you whether a permit is likely to be needed.
